The Balochistan Assembly has approved the Balochistan Child Marriages Restraint Act 2025. Under the new law, strict punishments have been set for those who engage in or facilitate child marriages.
According to the law, any individual under 18 years of age is considered a minor, and all child marriages across the province are illegal. In certain cases, such marriages will be declared void from the outset. This law holds precedence over all existing conflicting laws in the province and is effective immediately.
Punishments
If an adult man marries a minor, he will face two to three years in prison and a fine of one to two hundred thousand rupees.
Anyone who arranges, conducts, or assists in such a marriage will face the same punishment.
Failure to pay the fine may result in an additional three months of imprisonment.
Responsibilities of Nikah Khawan and Registrar
Nikah Khawans, marriage registrars, and union council secretaries are required to verify CNICs. Negligence can lead to one year imprisonment or a fine of one hundred thousand rupees.
All offences under this law are arrestable, non-bailable, and non-compoundable. Trials will be conducted only by a First-Class Judicial Magistrate.
The law also states that if a child is married after being kidnapped, sold, lured, forced, or trafficked, such a marriage will be considered void. However, any children born from such a marriage will be considered legitimate, and the father will be responsible for their maintenance.
Under this new act, the 1929 Child Marriage Act stands repealed in Balochistan; however, cases already under trial will proceed under the old law. The government must frame rules for implementation within six months.
Government & Opposition Reactions
Opposition members opposed the bill, deeming it un-Islamic. Chief Minister Sarfraz Bugti stated that the majority supported the law and that it reflects the strengthening of democratic processes. He said the bill was discussed in committees for six months, approved by the cabinet, and then presented in the assembly.
